Agreement to Terms

By accessing or using the Cirqle mobile application and services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the service.

Description of Service

Cirqle is a loyalty rewards platform that connects customers with participating merchants. Our services include:

  • Earning and redeeming loyalty points and rewards
  • Discovering promotions and special offers from merchants
  • Managing your membership and reward balance
  • Receiving personalized recommendations and offers

User Accounts

To use certain features of the service, you must register for an account. When you create an account, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security of your account by protecting your password and restricting access to your account
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

You must be at least 13 years old to create an account and use our services.

Loyalty Points and Rewards

The following terms apply to loyalty points and rewards:

  • Points are earned based on qualifying purchases at participating merchants according to their respective reward programs
  • Points have no cash value and cannot be exchanged for cash
  • Points may expire according to the terms set by each merchant program
  • Points are non-transferable between accounts unless explicitly permitted
  • We reserve the right to adjust, cancel, or expire points in cases of fraud, abuse, or system errors
  • Rewards and promotions are subject to availability and may be modified or discontinued at any time

User Conduct

You agree not to engage in any of the following prohibited activities:

  • Using the service for any illegal purpose or in violation of any local, state, national, or international law
  • Attempting to gain unauthorized access to other user accounts, computer systems, or networks
  • Interfering with or disrupting the service or servers and networks connected to the service
  • Creating multiple accounts for fraudulent purposes or to circumvent account restrictions
  • Manipulating or attempting to manipulate the points or rewards system
  • Using automated scripts, bots, or other tools to interact with the service
  • Impersonating another person or entity, or falsely stating or misrepresenting your affiliation with a person or entity

Intellectual Property

The service and its original content, features, and functionality are owned by Cirqle and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or included software without our prior written consent.

Third-Party Services

Our service may contain links to third-party websites or services that are not owned or controlled by Cirqle. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Cirqle shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any such websites or services.

Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. Cirqle expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

Limitation of Liability

In no event shall Cirqle, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Indemnification

You agree to defend, indemnify, and hold harmless Cirqle and its licensees and licensors, and their employees, contractors, agents, officers, and directors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the service, or your violation of these Terms.

Account Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease. Any accumulated points or rewards may be forfeited upon account termination due to violation of these terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the service shall be resolved through the courts of Indonesia.

Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
